14 Best Employment Lawyers in Hamburg

In Germany a dismissal can only be challenged within three weeks of receiving it, so the choice of lawyer usually has to be made fast. Hamburg's employment lawyers differ mainly in whose side they take: some act only for employees and works councils, others also advise employers, and a few concentrate on executives.

This guide lists firms whose own websites confirm employment law as a main field. For each one we note the Fachanwalt titles held, which clients they represent, how the first consultation works and whether advice is offered in English.

How this guide is ordered

Four things shaped this ranking of employment lawyers in Hamburg: how focused each business is on its trade, its standing with customers, how much it tells you about itself and which districts it covers. We revisit it whenever there is news.

Businesses are able to buy services that make them more visible in this guide.

How to choose Employment Lawyers in Hamburg

  1. Act within three weeksA claim against a dismissal must reach the labour court within three weeks of receiving the notice. Call a lawyer straight away, even if you hope to negotiate a settlement.
  2. Check whose side the firm takesSome firms act only for employees and works councils, others for employers too. If you want a lawyer with no employer clients, look for that statement on the firm's own site.
  3. Look for the Fachanwalt titleThe Fachanwalt für Arbeitsrecht is granted by the bar after extra training, exams and a minimum number of cases. It is not required, but it shows employment law is daily work.
  4. Clarify costs and insurance firstAt the first instance each side pays its own lawyer, whatever the outcome. Ask what the first consultation costs and whether your legal expenses insurance covers employment disputes.

Frequently asked questions

How much does an employment lawyer cost in Hamburg?

It varies. Fees follow the statutory RVG scale and depend on the value of the case, which for a dismissal claim is usually three gross monthly salaries. At the labour court of first instance each side pays its own lawyer even if it wins. Legal expenses insurance with employment cover often pays, people on low incomes can apply for legal aid, and several firms offer a free first assessment after a dismissal.

Do I have to sign a termination agreement?

No. A termination agreement is voluntary, and signing it can lead to a blocking period on unemployment benefit and the loss of dismissal protection. Ask for time and have a lawyer review the severance, the end date, garden leave and the reference before you sign.

Is there a legal right to severance pay in Germany?

Usually not. Severance is in most cases negotiated as part of a settlement, often after a dismissal protection claim has been filed. Exceptions include social plans and dismissals where the employer offers severance in exchange for not suing. The amount depends on length of service, salary and the chances of the claim succeeding.
